			<content:encoded><![CDATA[<p>Many lawyers are neglecting one of the the most powerful legal marketing tools available: search engines.  Although search engine marketing or optimization is best left to the experts, lawyers can help their cause by first hiring a competent web designers.  It is important that attorneys looking to improve their search engine rank know that a website designer is not a SEO specialist.  Quite the contrary, usually designers are usually worried about how a website looks and not whether it is well structured for search engine purposes though they might claim they know &#8220;SEO&#8221;.</p>
<p>This is not to say your presentation should be neglected.  Your website needs to tell potential clients that you are an established professional.  You can accomplish this on a budget for under $300, but better site designs will cost more.  Before hiring a webdesigner for your legal website, research on what different services and packages cost and the quality of work and reputation you are getting in exchange for your money.</p>

			<content:encoded><![CDATA[<p>The gaming world has had a huge effect on the Internet.  It has opened up a huge market online.  However, the game download industry, such as <a href="http://gameconsume.com">wii downloads</a>, has also created the need for new legislation and piracy laws.  The primary reason driving stricter enforcement of laws is peer to peer sharing or P2P.</p>
<p>P2P shares are when online game players make resources and other items (such as mp3s) available to others at no cost.  This is happening with <a href="http://gameconsume.com">mobile games</a> as well as standard home based games.  Sometimes this is not an illegal transaction at all.  For instance, some rock bands want their music to be shared to promote popularity and growth.  Nevertheless, typically established products or music are exchanged for free to the dismay of creators.</p>
<p>Many landmark cases have arisen for this with courts generally deciding in favor of license and copyright holders.  In essence, may shares across the internet are nothing more than hi-tech stealing.  You couldn&#8217;t go into a game store and take a free game home despite the fact one person has already purchased it.</p>

			<content:encoded><![CDATA[<p>An action is conduct or behavior on one&#8217;s part.  It can also mean a criminal or civil judicial proceeding.  Actions legally divide into several, related and independently distinct categories.  Related categories can fall under the type of entity you are bringing an action against.  For example, an in personam action is an action brought against a person while an action in rem is an action to determine the title to property and the rights of the parties with respect to it.</p>
<p>Action to quiet title is a proceeding brought to establish a plaintiff&#8217;s title to land by compelling an adverse claimant to establish a proper claim to the land or be estopped from asserting one.  A real action is an action brought for the recovery of land.  As you can see by this sampling, there are many types of actions.  Most can be defined by simply using a common sense approach.</p>

You have the burden of proving which of the two wills was created last.  There is going to be no will probated.  Court talks about the presumption of no revocation.  A presumption which will carry your burden if there is nothing to the contrary.</p>
<p>Lost wills Ashley case you have to prove up the instrument that revokes &#8211; this shifts the Burden of Proof. Dissenting opinion is attempting to say that that will is going to be allowed unless revocation is proven.  It is difficult to frame a negative issue.  Rule 76a deals with the possibility of a lost will.  The key words we want there is lost and destroyed.  We know there&#8217;s a will but we don&#8217;t know where it is.  The cause of nonproduction must be proven and must be satisfied by due diligence.  You first must show why you cannot produce the will.  You must prove content by testimony by credible witness who has heard the will and read it.  You must prove the content of what the will said.</p>

			<content:encoded><![CDATA[<p>Common Law is judge made law where courts create law where there is no present legal authority in the statutes or prior case law.  Judges have the legal authority to create law by making precedent.  Precedent is derived from common law and binds future decisions.  When parties disagree on what the actual law is during a case, a common law court will look to past precedent of relevant court authority to rule on that issue.  If a matter of dispute is unique from previous cases, it will be decided as a matter of first impression.  Courts are very careful in crafting new laws and usually seek to avoid the issue if the materiality of the case does not hinge on the issue.  This is common in Supreme Court cases where the justices will ignore an issue that is not necessary to decide the case.</p>

			<content:encoded><![CDATA[<p>Discretion within the courts has both positive and negative consequences.  First, discretion gives judges the ability to better handle circumstances on a case by case basis rather than adhering to hardline black letter law that may not properly address a situation at hand.  It, in a sense, invokes more common sense into the law.  However, the cons hold heavy weight.  First, this gives rise to judicial inconsistency in different courts on the same issue and sometimes even the same courts hold different ways.  Thus, a plaintiff may &#8220;win&#8221; in one state and &#8220;lose&#8221; in another.  Following, judges personal bias and thinking is intermixed in case law.  This is a largely unwanted consequence.  Ideally, laws would be mostly uniform across sovereign territories and not be influenced by a judges whim.  The study and application of law is no easy task, but I believe legislatures can improve upon the existing legal structure.</p>

			<content:encoded><![CDATA[<p>Welcome to Oliquig, a legal information and blogging site typing up daily news and notes.  This site covers all realms of the justice system.  Criminal law, torts, contracts, personal injury, insurance law, environmental law, and many more.  The legal world is now moving into the technological age and it is mostly for the better.  For example, courtrooms are using far less paper as they quickly integrate into a paperless system.  Also, discovery has become easier in most cases as computers can scan documents quickly for keywords being searched for.  However, on this token much more information has become discoverable such as attorney hard drives and emails.  It is now a question whether office emails are even privileged despite any legal disclaimer attached to the bottom.  Furthermore, technology has made contracts easier and more efficient.  Clients from all over the world can connect and bind themselves in a matter of seconds.  Although it should be noted the enforcement of these contracts can become a mess between jurisdictions and different laws.</p>
